Please read these Terms of Service ("Terms") carefully before using the DOSED platform. By creating an account or purchasing any Product, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Who We Are

DOSED is operated by:

Payment processing is handled by Creem OÜ ("Creem"), acting as our Merchant of Record. Creem is registered in Estonia and handles all payment processing, tax calculation, and compliance. Purchases are also subject to the Creem Terms of Service.

2. Eligibility

You must be at least 18 years of age to use DOSED. By creating an account, you represent and warrant that you meet this requirement and that all registration information you provide is truthful and accurate.

3. Definitions

• "Consumer" — a natural person acting for purposes outside their trade, business, craft, or profession, as well as a sole proprietor for whom the contract is not of a professional nature (Art. 7aa, Consumer Rights Act).
• "Digital Content" — data produced and supplied in digital form, including protocol libraries, databases, and downloadable guides.
• "Digital Service" — the DOSED web application and its interactive features, including the tracker, calculators, and analysis tools.
• "Products" — collectively, the Digital Content and Digital Services offered under DOSED Core, DOSED Pro, and DOSED Updates.

4. Products and Pricing

All prices include applicable VAT, calculated by Creem based on your billing country per EU digital services VAT rules. No physical goods are shipped.

5. Account Registration

To access DOSED, you must create an account using a valid email address. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately at contact@dosed.pro if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for more than 24 months.

6. Ordering and Payment

Orders are placed through the DOSED website and processed via Creem's secure checkout. By completing a purchase, you confirm that your billing information is accurate and that you authorize the charge.

An electronic receipt is sent to your email immediately upon successful payment. Your account is upgraded automatically within minutes.

7. Delivery of Digital Content

Digital content is delivered immediately upon payment confirmation in accordance with Art. 43c of the Consumer Rights Act. If you do not receive access within 24 hours, contact contact@dosed.pro with your order ID.

8. Right of Withdrawal

Under Art. 27 of the Consumer Rights Act (implementing Directive 2011/83/EU), you have the right to withdraw from this contract within 14 calendar days without giving any reason.

Exception: Pursuant to Art. 38(13) of the Consumer Rights Act, by requesting immediate access to digital content, you expressly consent to the commencement of performance before the withdrawal period expires and acknowledge that this results in the loss of your right of withdrawal. This consent is recorded during checkout.

If you have not accessed the digital content, you may withdraw by sending a clear statement to contact@dosed.pro within 14 days of purchase.

Refunds are processed by Creem within 14 days using the original payment method.

9. Conformity and Consumer Guarantees

In accordance with Chapter 5b of the Consumer Rights Act (implementing Directive 2019/770):

• Products must conform to their description, functionality, and intended purpose.
• We will provide necessary updates, including security updates, for a reasonable period.
• If a Product is non-conforming, you may request remediation. If remediation fails or is disproportionate, you may request a price reduction or withdraw from the contract.
• We are liable for non-conformity that becomes apparent within 2 years of delivery.

10. Subscription Terms

DOSED Updates renews automatically on the same calendar date each month.

• Cancellation: Cancel any time via the Creem customer portal. Access continues until the end of the current billing period.
• Price changes: We will notify active subscribers at least 30 days before any price increase. Continued use after the effective date constitutes acceptance.
• No partial refunds for the remaining portion of a billing period after cancellation.

11. Acceptable Use

You agree not to:

• Resell, redistribute, sublicense, or publicly share Product content.
• Use automated tools (bots, scrapers) to extract data from the platform.
• Reverse-engineer, decompile, or derive source code from the application.
• Circumvent access controls, authentication, or security mechanisms.
• Use the Products for any unlawful or harmful purpose.
• Impersonate another person or misrepresent your affiliation.

Violation may result in immediate suspension or termination of access without refund.

12. Intellectual Property

All content, designs, databases, code, trademarks, and trade names within the DOSED platform are the exclusive property of Globotics sp. z o.o. or used under license. Your purchase grants a personal, non-transferable, non-exclusive, revocable license to use the Products for their intended purpose.

You retain ownership of data you input into the platform (e.g., tracker logs, ratings). We do not claim ownership of your personal data.

13. Disclaimer of Warranties

DOSED Products are provided "as is" and "as available." To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Specifically:

• DOSED is an educational information product, not a medical, pharmaceutical, or professional health service.
• Content is based on personal experience and published research references. It does not constitute medical advice.
• We do not warrant that the Products will be uninterrupted, error-free, or free of harmful components.
• We do not guarantee any specific health, performance, or optimization outcomes.

Always consult a qualified medical professional before starting any supplement protocol.

This disclaimer does not affect your mandatory consumer rights under Polish and EU law, which cannot be excluded or limited.

14. Limitation of Liability

To the maximum extent permitted by applicable law:

• Our total aggregate liability arising out of or relating to these Terms or your use of the Products shall not exceed the total amount you paid us in the 12 months preceding the claim.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
• We are not liable for any harm, adverse health effects, or damages arising from the use or misuse of information provided in the Products.

These limitations do not apply to liability that cannot be excluded under applicable law, including mandatory consumer protection provisions.

15. Indemnification

If you use the Products for business or commercial purposes (i.e., you are not acting as a Consumer), you agree to indemnify, defend, and hold harmless Globotics sp. z o.o. and its officers, directors, and employees from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Products or violation of these Terms.

This section does not apply to Consumers.

16. Complaint Procedure

To file a complaint:

1. Email contact@dosed.pro with the subject "Complaint — [Order ID]".
2. Include your name, email, order ID, description of the issue, and desired resolution.

We will respond within 14 calendar days (Art. 7a, Consumer Rights Act).

If unsatisfied, you may:

• Use the EU Online Dispute Resolution (ODR) platform.
• Request mediation through the Polish Trade Inspection (Inspekcja Handlowa).
• Submit a case to the Permanent Consumer Arbitration Court (Stały Polubowny Sąd Konsumencki).
• Contact your local consumer ombudsman (Powiatowy/Miejski Rzecznik Konsumentów).

17. Termination

You may terminate your account at any time by contacting contact@dosed.pro. We will delete your account and associated data in accordance with our Privacy Policy, subject to legal retention obligations.

We may suspend or terminate your access if:

• You breach these Terms.
• We are required to do so by law.
• Your account has been inactive for more than 24 months.

Termination does not affect any rights or obligations that accrued prior to termination, including your right to file complaints or exercise consumer rights.

18. Force Majeure

We are not liable for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, government actions, power failures, internet disruptions, or third-party service outages.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. All remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any product-specific terms referenced herein, constitute the entire agreement between you and Globotics sp. z o.o. regarding your use of the Products. They supersede all prior agreements, communications, and understandings, whether written or oral.

21. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to an affiliate or successor in connection with a merger, acquisition, or sale of assets, provided your rights under these Terms are not diminished.

22. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with Polish law.

For Consumers residing in EU member states, mandatory consumer protection laws of your country of residence also apply insofar as they provide a higher level of protection (Art. 6(2), Regulation (EC) No 593/2008 — Rome I).

Disputes shall be resolved by the competent courts in Warsaw, Poland, unless mandatory provisions of the Consumer's country of residence designate a different jurisdiction.

23. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

• The updated Terms will be published on this page with a new effective date.
• Registered users and active subscribers will be notified by email at least 30 days before changes take effect.

Continued use after the effective date constitutes acceptance. If you disagree with the changes, you may terminate your account.

This Privacy Policy explains how we collect, use, store, and protect your personal data when you use the DOSED platform. We are committed to processing your data lawfully, fairly, and transparently in accordance with the General Data Protection Regulation (EU) 2016/679 ("GDPR") and Polish data protection law.

1. Data Controller

As the Data Controller within the meaning of Art. 4(7) GDPR, we determine the purposes and means of processing your personal data.

2. Personal Data We Collect

Data you provide directly

• Account data: Email address (used for authentication and communication).
• Usage data: Supplement logs, sleep/energy/focus/mood ratings, tracker progress, and notes you enter into the application.
• Communication data: Correspondence when you contact us for support or feedback.

Data collected automatically

• Technical data: IP address, browser type and version, operating system, device type, referral URL, pages visited, and timestamps.

Data from third parties

• Transaction data (via Creem): Purchase confirmations, order IDs, billing country, product tier. We do not receive or store your payment card details — these are handled exclusively by Creem.
• Newsletter data (via Beehiiv): Subscription status and email engagement metrics.

We do not collect special categories of personal data as defined in Art. 9 GDPR (health data, biometric data, genetic data, political opinions, religious beliefs, sexual orientation, racial or ethnic origin).

The supplement tracking and mood ratings in DOSED are self-reported lifestyle observations used for personal tracking purposes — they are not medical or health data and are not used for diagnosis, treatment, or medical research.

Where we rely on legitimate interest (Art. 6(1)(f)), you have the right to object (see Section 7).

4. Who We Share Your Data With

We share your data only with trusted third-party processors who are contractually bound to process data in accordance with our instructions and the GDPR (Art. 28).

We do not sell, rent, or trade your personal data. We do not share data with advertisers or data brokers.

We may disclose personal data if required by law, regulation, legal process, or enforceable governmental request.

5. International Data Transfers

Some of our processors are located outside the European Economic Area (EEA). All international transfers are protected by:

• Standard Contractual Clauses (SCCs) approved by the European Commission (Decision 2021/914), incorporated into Data Processing Agreements with each processor.
• Where applicable, adequacy decisions by the European Commission (Art. 45 GDPR).
• Supplementary technical measures where necessary based on transfer impact assessments.

6. Data Retention

We retain personal data only for as long as necessary to fulfill the purposes for which it was collected, or as required by law.

When the retention period expires, data is permanently deleted or irreversibly anonymized.

7. Your Rights

Under the GDPR, you have the following rights regarding your personal data:

How to exercise your rights: Send an email to contact@dosed.pro with the subject "Data Rights Request". We will verify your identity and respond within 30 days. This period may be extended by up to 60 days for complex requests, with notification.

Exercising your rights is free of charge. However, we may charge a reasonable fee for manifestly unfounded or excessive requests (Art. 12(5) GDPR).

8. Cookies and Local Storage

In accordance with the Polish Telecommunications Law (Prawo telekomunikacyjne, Art. 173) and the ePrivacy Directive:

We do not use:

• Google Analytics or any third-party analytics platform.
• Facebook Pixel, advertising cookies, or retargeting tags.
• Cross-site tracking technologies.
• Fingerprinting or similar identification techniques.

Do Not Track (DNT): We respect Do Not Track browser signals. Since we do not perform any tracking beyond essential functionality, no additional action is needed when DNT is enabled.

9. Data Security

We implement appropriate technical and organizational measures to protect your personal data in accordance with Art. 32 GDPR:

• Encryption in transit: All connections use TLS/HTTPS.
• Encryption at rest: Database-level encryption on all stored data.
• Access controls: Row-Level Security (RLS) ensures users can only access their own data.
• Authentication: Secure token-based sessions with bcrypt password hashing.
• Principle of least privilege: Only necessary personnel have access to production systems.
• Content Security Policy: Restricts script execution and connection sources.

10. Data Breach Notification

In the event of a personal data breach:

• We will notify the Polish Data Protection Authority (UODO) within 72 hours of becoming aware of the breach, as required by Art. 33 GDPR.
• If the breach is likely to result in a high risk to your rights and freedoms, we will notify affected individuals without undue delay (Art. 34 GDPR).
• Notifications will include: the nature of the breach, the data affected, the likely consequences, and the measures taken to address it.

11. Children's Privacy

DOSED is not directed at individuals under 18 years of age. We do not knowingly collect personal data from minors. If you believe a minor has created an account, please contact us immediately at contact@dosed.pro and we will promptly delete the account and associated data.

12. Supervisory Authority

You have the right to lodge a complaint with your supervisory authority. For Poland:

Residents of other EU/EEA member states may contact their local data protection authority.

13. Changes to This Policy

We may update this Privacy Policy to reflect changes in our practices, legal requirements, or services. Material changes will be:

• Published on this page with a new effective date.
• Communicated by email to registered users at least 30 days before taking effect.

We encourage you to review this policy periodically.
