Legal status in Germany

Prescription-only medicine. Authorized in Germany for narcolepsy. Standard Rezept — not a BtM-Rezept. Removed from BtMG Anlage III in 2008.

Approval and regulatory body

BfArM-authorized as Vigil (Cephalon/Teva) 100 mg and 200 mg tablets. Generic formulations also authorized (e.g. Modafinil-neuraxpharm). Sole authorized indication after the 2010 EMA Article 31 referral: excessive sleepiness associated with narcolepsy with or without cataplexy in adults.

Scheduling

Removed from BtMG Anlage III in March 2008 by the 21. Verordnung zur Änderung betäubungsmittelrechtlicher Vorschriften. Now a standard verschreibungspflichtiges Arzneimittel under AMVV. Not a controlled narcotic and does not require a BtM-Rezept — a common misconception.

Doping (WADA) status

WADA prohibited list 2026: listed under S6.A (Non-Specified Stimulants). Banned in-competition only — permitted out-of-competition. Non-Specified Substance, default 4-year ban for first violation. See the official WADA Prohibited List.

Prescription reality

Any licensed German physician can issue a standard Rezept for modafinil for the narcolepsy indication. Diagnosis typically requires specialist evaluation and sleep studies (polysomnography/MSLT). Off-label prescribing for shift work, idiopathic hypersomnia, or cognitive enhancement is legally permissible under German medical practice but requires documented patient consent and is not GKV-reimbursed.

Compounding pharmacy nuance

Not relevant — finished authorized products exist.

Research-use legal basis

Not applicable. Modafinil is a finished medicinal product. Research chemical or grey-market sale outside the prescription pathway violates AMG.

Import & customs in Germany

Lawful only via EU-authorized Versandapotheken with valid prescription. Mail-order without prescription violates AMG.

Non-EU personal import

Prohibited under §73 AMG. The personal travel-necessity exemption may apply to small quantities a traveller carries with a foreign prescription. Mail-order from offshore vendors (commonly India: Modalert, Modvigil) is regularly seized by Zoll. Drugcom.de (BZgA) explicitly warns this can be a criminal offence under AMG.

Typical seizure outcome

Letter from Zoll requesting prescription proof. Without proof, shipment is destroyed. Prosecution of individual buyers is rare but possible.

Market reality on the ground

Pharmacy availability: Vigil 100 mg, 30 tablets retails at approximately €50–€80 per pack. Generic Modafinil-neuraxpharm somewhat cheaper.

Telehealth pathway: No mainstream German telehealth provider publicly advertises modafinil prescribing because the narcolepsy indication requires specialist confirmation. Some EU-wide telehealth services may consult on sleep disorders.

Domestic research-chem sellers: Not sold as a research chemical. Vigil and Modafinil-neuraxpharm are pharmacy-only.

Underground use: Widespread off-label cognitive enhancement use among German university students, professionals, and biohackers. Grey-market online purchases (Modalert, Modvigil) are common and documented by BZgA's drugcom.de.
